End User Licence Agreement

Plain-language first. Each section opens with a short summary in ordinary words, then the actual terms. The summaries are there to be read; the terms are what govern. Where they ever seem to disagree, the terms are what apply. This is a real agreement between you and the person who makes The Familiar — it isn’t legal advice to you, and reading it doesn’t make me your lawyer.

1.Your licence

You’re allowed to use the app on your own devices, for yourself. You don’t own the software itself, and you can’t resell it or take it apart.

I grant you a personal, non-exclusive, non-transferable, revocable licence to download and use The Familiar on devices you own or control, for your own personal and non-commercial use, in line with these terms and the app-store rules that apply to it. The app is licensed, not sold, to you.

2.What you agree not to do

  • Copy, sell, rent, lease, sublicense, or redistribute the app.
  • Reverse-engineer, decompile, or disassemble it, or try to extract its source code, except where the law expressly permits despite this restriction.
  • Remove or alter any proprietary notices.
  • Use it in a way that breaks these terms, the Acceptable Use policy, or the law.

3.Ownership

The app, and everything in it other than your own content — the software, the creature, the artwork, the name and the look — belongs to me or my licensors, and is protected by intellectual-property law. Nothing here transfers those rights to you.

4.Updates

The app may update itself, or be updated through your app store, to fix problems or add and change features. These terms apply to updated versions too.

5.App-store terms

Whichever store you got the app from has its own rules, and by using the app you accept the relevant ones below.

You must also comply with the terms of the app store you downloaded from (the Apple App Store or Google Play). Where those rules conflict with this licence for what you can do with the app, the stricter applies.

Apple App Store

This licence is between you and me only, not with Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide support for the app. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. I, not Apple, am responsible for addressing any claims relating to the app, including product-liability, legal-compliance, and consumer-protection claims, and any third-party claim that the app infringes intellectual-property rights. Apple and its subsidiaries are third-party beneficiaries of this licence and may enforce it against you. You represent that you are not located in a country subject to a US embargo or designated as “terrorist-supporting”, and that you are not on any US restricted-party list.

Google Play

Your use is also subject to the Google Play Terms of Service. Google is not a party to this licence and is not responsible for the app.

6.Disclaimer and law

The app is licensed “as is”, and the disclaimers, liability limits and governing law in the Terms of Use apply to this licence as well.
